Widower loses fight to stay in UK
A Filipino man whose wife died after being given an epidural in the arm rather than the spine during childbirth has lost his fight to stay in the UK.

He has no legal standing to remain. After the loss of his wife, it appears he sent his son to be raised in the Philippines, rather than establish a home for the child in the UK.

I'm not of the opinion that deporting him is necessarily wrong, but it definately harsh considering the circumstances.

Not having been privy to all the details, just looking at the reported circumstances.
1. I am sure he would have received some form of compensation for the wrongful death of his wife.
2. I cannot see in the article if the boy ever resided in the UK apart from the time of his birth and shortly thereafter, until he was sent to "live" in the Philippines. As a side note, surely he could have mounted a successful case to have a relative to come over from the Philippines to assist in raising the child in the UK, it appears he chose not to do that.
3. He was allowed into the country on a work visa because of her occupation as a Nurse. I am not completely understanding of the immigration laws of the UK, but most countries cover themselves by having a clause in the visa system to prevent people entering the country under a work visa, having a child during the tenure of their work visa and then using the birth of the child as a reason to get permanent residency status.
4. His wife died in 2004 and a decision was made in 2008 for him to leave the UK, he has had four years to establish a home for the child in the UK, again, why he has not done this, who can say.

Unfortunate for the man that his wife died, and actually odd a hospital would make such a blunder!
But what his real desires were you won't know [whether he was using the child as a way to get permanent residency..]
